Adam Gilbertson will be sharing his insights on the Emotional Perception decisions and discussing his experience on their impact on patent practice in the UK over the past eighteen months as the case has developed.
The case of Comptroller – General of Patents, Designs and Trade Marks v Emotional Perception AI Limited pivots on the question of whether AI systems, specifically those involving artificial neural networks (ANNs), are patentable under UK law. In July 2024, the Court of Appeal ruled that Emotional Perception’s invention was excluded from patentability due to it being “a program for a computer…as such” which lacked the necessary technical contribution. However, at the end of last year, the UK Supreme Court granted permission to Emotional Perception to appeal this decision.
The Supreme Court hearing is expected to take place in mid-2025 and will be highly consequential for the future of AI-related inventions and their patentability.
