For priority purposes, the EPO requires applicant identity between the European and earlier applications or a succession in title. Failure to pass the ‘same applicant’ test is a common cause of loss of priority before the EPO, particularly in US-originating cases. Applicants therefore need to be aware of the EPO rules before they file a priority-claiming European application or international application designating Europe.
Mathys & Squire partners Philippa Griffin and James Wilding will review the EPO requirements for ‘same applicant’ priority in light of recent case law, and they will discuss practical steps applicants can take to ensure those requirements are met.
