For priority purposes, the EPO requires applicant identity between the European and earlier applications or a succession in title. Failure to pass the ‘same applicant’ test is a common cause of loss of priority before the EPO, particularly in US-originating cases. Applicants therefore need to be aware of the EPO rules before they file a priority-claiming European application or international application designating Europe.
