Toby's patent practice lies principally in the fields of pharmaceuticals and chemistry. He specialises in drafting and prosecuting patent applications relating to pharmaceutical products (including new chemical entities, peptide and antibody therapeutics, pharmaceutical formulations, polymorphs, salts, new medical uses and dosage regimes), medical devices, cosmetic products (including hair and skin care products), food chemistry, polymer chemistry, analytical chemistry and nanotechnology. He also has expertise in matters such as supplementary protection certificates (SPCs) and regulatory data protection.
Toby has extensive experience of opposition and appeal proceedings before the European Patent Office, and regularly represents clients in relation to such matters. In particular, he has successfully defended a number of key European patents in opposition/appeal proceedings, including patents directed to pharmaceutical products (bortezomib/Velcade®, temozolomide/Temodal®, linaclotide/Linzess® and cabozantinib/Cabometyx®), cosmetic products (Head & Shoulders® and Clairol® products), and medical devices (Zilver® stents).
Toby studied chemistry at the University of Oxford, graduating with a first class master's degree. He qualified as a Chartered Patent Attorney and a European Patent Attorney in 2006, and also holds a certificate in intellectual property law from the University of London. Toby became a partner of the firm in 2011.
