Trade Marks
Our trade mark practice includes:-
- Counselling clients on trade mark opportunities and risks;
- Securing the registration of trade marks in Europe and worldwide;
- Oppositions and other validity challenges;
- Advising on management and exploitation of trade mark portfolios; and
- Enforcing trade marks and associated rights, often in cooperation with professional colleagues.
We understand that the value in a brand can be enormous. Investments in product design; in launching a product or service; and in sustaining marketing can be considerable. We have the expertise to protect the commercial value of customer goodwill; to create tradable business assets; and to manage risk.
Our specialist trade mark division advises brand owners or their agents across all fields of industry on all aspects of trade marks, including creation, searching, registration and enforcement. Our primary aim is to help our clients to secure strong trademark rights and to protect their chosen trademarks worldwide from potential misuse by third parties.
Often, trade mark and design strategies will overlap to maximise protection.
We work with clients at an early stage to advise on features that should sensibly be protected (from brand names to logos, slogans, product appearance, artwork, colour, packaging, get-up and even sounds) and to advise against those that carry high risk. We know you need to move quickly and therefore so do we.
Disputes and conflicts with prior rights, will sometimes arise and we adopt a commercial approach, seeking solutions that meet our clients’ needs, before moving to more formal routes to challenge or enforce rights.
