Harvey is the leader of the Life Sciences & Chemistry group of Mathys and Squire LLP. He has worked for the firm since 1999, having previously worked elsewhere in Private Practice. He has been a Partner of the firm since 2002. Harvey has a Masters Degree in Biochemistry, with Supplementary Chemical Pharmacology, from Oxford University, and was awarded the University's Gibbs prize. When qualifying as a Patent Attorney, he won the Strode and Ballantyne prizes from the UK Chartered Institute of Patent Attorneys. He also holds a Certificate in Intellectual Property from London University and a Diploma in Intellectual Property Litigation from Nottingham Law School.
Harvey works in the fields of biotechnology, biochemistry, molecular biology and organic chemistry, with particular expertise in antibodies and immunology, stem cell biology, gene therapy and pharmaceutical chemistry.
Harvey specialises in the area of contentious inter partes proceedings before the European Patent Office, and has considerable experience in both oppositions and appeals. He applies this first-hand knowledge to his drafting and prosecution practice, so as to maximise the strength of his client's patents against subsequent opposition or litigation. He is proficient at handling contentious cases involving parallel proceedings in multiple jurisdictions, and has experience in the conduct of pan-European litigation. He has been involved in numerous key disputes in the biotechnology space, including Ladner / McCafferty (phage display); Noelle / Lederman (antibodies to CD40CR), and the oppositions against the Queen estate (antibody humanisation). He has successfully defended patents protecting significant therapeutic drugs including Avonex® (interferon beta), Temodal® (temozolomide), and Clarinex® (desloratadine).
Harvey’s principal clients include Biogen Idec Inc., Genzyme Corporation, Schering-Plough Corporation / Merck & Co., Inc., Dyax Corp., Abbott Laboratories, and The Procter & Gamble Company.
